Frequently Asked Questions Clients Often Ask Before Divorce Mediation
Can we mediate if we don't agree on everything?
Yes—most clients begin the mediation process with disagreements. Mediation isn't about agreeing from the start; it's about creating space for respectful dialogue and practical solutions.
What if the other person is difficult or emotional?
You don't need to have perfect communication to benefit from mediation. With a skilled mediator guiding the process, both parties have the chance to be heard and stay focused on resolution—not conflict.
Is mediation still an option if we've already filed in court?
Yes. You can still choose mediation even if court proceedings have started. In fact, many families find it helpful to pause litigation and resolve matters privately before returning to court to finalize agreements.
How is this different from court-ordered mediation?
Private mediation offers a more flexible and thorough approach than court-ordered mediation. If you're comparing options, you can learn more about Court-Ordered Mediation here.
What if we can't agree on whether to mediate?
Mediation is voluntary, so both parties must agree to participate. If you're unsure how to start that conversation, we can guide you or provide neutral language to help you invite the other person to consider it.
Do I still need a lawyer if we use mediation?
Many parents choose to consult with an attorney before, during, or after mediation. Mediation helps facilitate discussion and agreement, while legal advice helps you understand your rights and options before making important decisions.
